U-EAT.COM PRIVACY POLICY
U-Eat.com (“U-Eat.com,” “us” or “we”) respects the privacy of visitors to our Sites and registrants of our Services. This Privacy Policy intended to inform you of our policies and practices regarding the collection, use and disclosure of any Personal Information you submit to use through our Sites. Any capitalized term used but not defined in this Privacy Policy shall have the meaning given in the U-Eat.com User Agreement, which is available by clicking here.
U-Eat.com provides certain websites, including the websites available at the domain name akatekgrp.com (each, a “Site”) and certain services made available to registered users of the Sites (“Services”). By submitting any information through a Site or registering for any Services, you acknowledge and agree that U-Eat.com may process (i.e., collect, use, etc.) your Personal Information as described in this Privacy Policy.
You expressly consent to the processing of your Personal Data according to this Privacy Policy. Personal Data may be processed by U-Eat.com in the country where it was collected as well as other countries where laws regarding processing of Personal Data may be less stringent.
THE TYPES OF INFORMATION WE COLLECT
U-Eat.com COLLECTS Personal Information and Anonymous Information from you when you visit a Site, use the Services, and/or send us information or communications. “Personal Information” means information that allows someone to identify or contact you, including, for example, your name, address, telephone number, e-mail address, as well as any information about you that is associated with or linked to any of the foregoing information. “Anonymous Information” means information that is not associated with or linked to your Personal Information, including any feedback you may provide; Anonymous Information does not permit the identification of individual persons. We collect and use Personal Information and Anonymous Information as described in this Privacy Policy.
Personal Information You Provide to Us
We may collect Personal Information that you submit to us voluntarily through your access and/or use of a Site, including your user name password, billing name and address, contact information such as phone numbers or e-mail addresses, and credit card information.
Personal Information Collected Via Technology
As you access and/or use the Site and/or Services, we may collect certain information, such as unique identifiers for your wireless communication device, your product purchase preferences, and the locations from which you order the Products, and details involving the time, place, cost, number of items and other features of your orders.

U-Eat.com may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on the Sites. Persistent cookies can be removed by following Internet browser help file directions. If you choose to disable cookies, some areas of the Site and the Services may not work properly.
HOW TO USE YOUR INFORMATION
In general, we use your Personal Information to respond to your requests as submitted through the Services and to charge your credit card the cost and transaction fee associated with the Products you request. In addition, we may use your Personal Information to determine your purchase preferences, to better understand how the Sites and Services are used; to gauge traffic patterns and determine what types of content and services are most popular with users; and to contact you with information about U-Eat.com’s products, services, news and events. We will share your Personal Information with third parties who perform services for us or on our behalf. You expressly consent to the sharing of your Personal Information with these third parties.
We may create Anonymous Information records from Personal Information excluding information (such as your name) that make the information personally identifiable to you. We may use this Anonymous Information to analyse request patterns and usage patterns so that we may enhance our products and services. U-Eat.com reserves the right to use and disclose Anonymous Information to third parties in its discretion.
We may also use your Personal Information to send information on products, services, special offers, and promotions. Out of respect for your privacy, we give you the option not to receive these types of communications. If you would like to cease receiving any such communications, you may unsubscribe by sending an email to unsubscribe@u-eat.com. You may not opt out of non-promotional communications from U-Eat.com, including confirmation messages regarding successful order requests.
Although we currently do not have a parent company, any subsidiaries, joint ventures, or other companies under common control (collectively, “affiliates”), we may in the future. We may share some or all of your Personal Information with these affiliates, in which case we will require our affiliates to honour this Privacy Policy. If another company acquires our company or our assets, that company will possess the Personal Information collected by us and it will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy.
We may disclose your Personal Information if we believe in good faith that such disclosure is necessary (a) to comply with relevant laws or to respond to subpoenas or warrants served on U-Eat.com; or (b) to protect and defend the rights or property of U-Eat.com or users of our website.
Feedback If you provide feedback on any of our products or services to us, we may use such feedback for any purpose, provided we will not associate such feedback with your Personal Information. U-Eat.com will collect any information contained in such communication and will treat the Personal Information in such communication in accordance with this Privacy Policy.
Regarding Children
We do not intentionally gather Personal Information about visitors who are under the age of 15. Furthermore, we do not intentionally allow visitors under the age of 18 to register for the Services.
Links to Other Sites
Our provision of a link to any other website or location is for your convenience and does not signify our endorsement of such other website or location or its contents. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of our Privacy Policy do not apply to these outside websites.
HOW WE PROTECT YOUR INFORMATION
We use reasonable measures to maintain the security of your Personal Information. U-Eat.com makes use of Secure Sockets Layer (SSL) technology and keeps sensitive details stored in an encrypted format in the U-Eat.com database.
U-Eat.com has implemented other industry-standard electronic means of protecting your Personal Information. We store Personal Information behind a computer firewall, a barrier designed to prevent outsiders from accessing our servers. In addition, U-Eat.com protects your Personal Information in a controlled facility. Except as provided elsewhere in this Privacy Policy, U-Eat.com limits access to Personal Information in electronic databases to those persons (including employees and contractors) in U-Eat.com’s organization that have a business need for such access.

U-Eat.com, (“U-Eat.com” “the Company,” “we,” or “us,”) provides certain websites, including the websites available at the domain name U-Eat.com (each, a “Site”) and certain services made available to registered users of the Sites (“Services”). This U-Eat.com User Agreement is the legal agreement (“Agreement”) between you and U-Eat.com governing your use of the Services. Please read this Agreement carefully. U-Eat.com is willing to provide the Services to you only on the condition that you accept all of the terms and conditions contained in this Agreement. You accept the terms and conditions of this Agreement by registering for and using the Services. If you are unwilling to accept this Agreement, do not use the Services.
1. DESCRIPTION OF SERVICES. Subject to your compliance with the terms and conditions of this Agreement, U-Eat.com will provide the Services to you have successfully completed the registration process for the Services, which is made available to you through the Sites. Upon U-Eat.com’s acceptance of your registration for the participation in the Services, U-Eat.com will send you an SMS text message containing an authorization key and validated your status as an authorized user of the Services, you will be able to make use of wireless communication devices, such as cellular telephones, to place orders and settle transactions for the purchase of certain third-party products (each, a “Product”) contained in an order catalogue, as updated by U-Eat.com from time to time (“Product Catalogue”). The communication standards for the Services include, but not limited to: SMS, GPRS, and web-based browser technology, provided that in order to use the Services, you must maintain an active account with a carrier of electronic communications through mobile devices (each, a “Carrier”), and you may not use a prepaid cellular phone contract to access the Services.
2. AVAILABILITY OF SERVICES. You acknowledge and agree that the availability of SMS, the internet, and your ability to use the Services is on an “AS IS” and “AS AVAILABLE” basis. You acknowledge that the delivery of SMS messages and availability of web-based browsing is not guaranteed. You acknowledge that the Services may differ depending on the Carrier with whom you maintain an account and that Carrier’s ability to support the Services. U-Eat.com is not responsible for the act of omission of any Carrier, any limitations imposed by such Carrier, or such Carrier’s ability to support the Services. U-Eat.com is not responsible for the act or omission of any Carrier, any limitations imposed by such Carrier, or such Carrier’s ability or inability to support the Services. In addition, U-Eat.com is not responsible for any limitations of the internet. In the event your Carrier fails to deliver any communication to U-Eat.com or a provider of any Product in timely fashion, due to, but not limited to, mobile network failure or non-compatibility of your phone model with the Services, you acknowledge and agree that U-Eat.com shall not liable for any loss or damage. In addition and without limiting the foregoing, in no event will U-Eat.com be liable for any error by you in using the Services, including submission of an order or other message to an incorrect allocated number or short code.
3. MODIFICATION OF SERVICES. U-Eat.com reserves the right, in its sole discretion, to modify the Services from time to time and without notice, including by removing, adding, or modifying Products and/or third-party vendors from the Product Catalogue. U-Eat.com shall have no liability to you for any modification or discontinuation of Services. If you object to any such changes, your sole recourse shall be cease using the Services. Continued use of the Services following any such changes shall indicate your acknowledgment of such changes and satisfaction with the Services as so modified.
4. PAYMENTS AND BILLING. You acknowledge and agree that for each order you place through the Service, the full cost of Products you order (for which prices are subject to change without notice) assessed against your credit card or charge card. You acknowledge and agree that a SMS or web browser command originating from your account constitutes an authorization for U-Eat.com to charge this amount to your credit card or charge card, and you assume all liability for and shall promptly pay any and all charges. Without limiting the foregoing, you acknowledge and agree that you will pay assessed charges for any and all orders placed from your account, regardless of whether you actually receive the Products. In addition, you agree to pay all fees charged by your Carrier in connection with your use of the Services. You acknowledge and agree that these rates depend on the applicable Carrier and your personal subscription package with that Carrier. U-Eat.com will provide you with reasonable notice of any material modification in the fees charged for the Services, which notice may be provided by posting the new fee schedule on the Sites. You will be able to choose between U-Eat.com’s pay-as-you-go and prepaid payment plans. The pay-as-you-go plan allows you to pay for each transaction individually, while the prepaid plan allows you to transfer £25.00 or more from your credit card or charge card and have your transactions deducted directly from your account balance.
5. LIMITATIONS ON YOUR USE OF THE SERVICES. You may not attempt, or authorize, encourage or support other’s attempts, to circumvent, reverse engineer, decrypt, break or otherwise alter or interfere with the Service. You agree to advise U-Eat.com promptly of any such unauthorized use(s) or attempt(s). You acknowledge and agree that the Services are for your personal use only. You acknowledge and agree that you may not copy, distribute, sell, resell, or exploit for any commercial purposes any portion of the Services, or any products accessible through the Services. U-Eat.com is not liable for any claims, actions, damages, or other liability incurred as a result of any unauthorized access.
6. MODIFICATION OF AGREEMENT. U-Eat.com may amend, supplement, or modify this Agreement from time to time by posting the amended Agreement on the Sites, and you agree to be bound by any such amendment or modification. If you object to any such changes, your sole recourse shall be to cease using the Services. Continued use of the Services following posting of any such changes shall indicate your acknowledgment of such changes and agreement to be bound by the revised Agreement, inclusive of such changes.
7. PRIVACY. As part of the registration process, you will be asked to provide certain personal information to us, such as your name, contact information, and credit card number. U-Eat.com has an unrestricted right to collect and use any personal information you provide in connection with the Services, provided that any such use shall be in accordance with our Privacy Policy available at www.U-Eat.com, which is hereby incorporated by reference. If you use the Sites and/or the Services, you are accepting the terms and conditions of our Privacy Policy. If you do not agree to have your information used in any of the ways described in the Privacy Policy, you must discontinue use of the Sites and/or Services.
8. TERMINATION. U-Eat.com may suspend your ability to use the Services or may terminate this Agreement effective immediately and without notice to you if (a) U-Eat.com receives repeated faulty orders for Products in connection with your account, including but not limited to the use of erroneous or spoof SMS orders or duplicate requests for Products; (b) your use of the Services is resulting in excessive charge backs on the credit card associated with your account; (c) you fail to make timely payment of any amounts when due; or (d) U-Eat.com believes you have violated or acted inconsistently with the letter or the spirit of this Agreement. After any suspension or termination, you may be required to respond to an authenticating message to reactivate your account and/or pay a reactivation fee. YOU AGREE THAT U-EAT.COM SHALL NOT BE LIABLE TO YOU FOR ANY TERMINATION OF THIS AGREEMENT OR OF YOUR ACCESS TO THE SERVICES. You may discontinue your participation in and access to the Services at any time by delivering notice to U-Eat.com at support@u-eat.com, or by sending a text message to the U-Eat.com short code (XXXXX) with any of the following messages: “STOP,” “CANCEL,” “UNSUBSCRIBE,” “QUIT,” “STOP ALL,” or “END.”
9. DISCLAIMER OF WARRANTIES. YOU EXPRESSLY AGREE THAT USE OF THE SERVICES IS AT YOUR OWN RISK. THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. U-EAT.COM EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTIBILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE, AND NON-INFRINGEMENT. U-EAT.COM MAKES NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICES WILL BE UNITERRUPTED, TIMELY, SECURE, OR ERROR FREE. U-EAT.COM DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SERVICES WITH RESPECT TO PERFORMANCE, ACCURACY, RELIABILITY, SECURITY CAPABILITY, CURRENTNESS OR OTHERWISE. YOU UNDERSTAND AND AGREE THAT ANY PRODUCTS YOU OBTAIN THROUGH USE OF THE SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK, AND U-EAT.COM MAKES NO WARRANTY REGARDING ANY DEALINGS WITH OR TRANSACTIONS ENTERED INTO WITH ANY OTHER PARTIES THROUGH THE SERVICES. THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY, EFFORTS AND RESULTS TO BE OBTAINED THROUGH THE USE OF THE SITES OR THE SERVICES IS WITH YOU. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM U-EAT.COM OR THROUGH THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.
10. LIMITATION OF LIABILITY. YOU UNDERSTAND THAT TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT WILL U-EAT.COM OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS OR LICENSORS BE LIABLE FOR ANY INDIRECT, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF REVENUES, PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF SUCH PARTIES WERE ADVISED OF THE POSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR RELATED TO YOUR USE OF THE SITES OR THE SERVICES, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), WARRANTY, STATUTE OR OTHERWISE. THE PARTIES ACKNOWLEDGE THAT THE TERMS OF THIS SECTION 10 WOULD NOT ENTER INTO THIS AGREEMENT WITHOUT THESE LIMITATIONS OF LIABILITY. THE AGGREGATE LIABILITY OF U-EAT.COM TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITES OR THE SERVICES IS LIMITED TO ONE HUNDRED POUNDS (£100). Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations and disclaimers may not apply to you. To the extent that we may not, as a matter of applicable law, disclaim any implied warranty or limit its liabilities, the scope and duration of such warranty and the extent of our liability shall be the minimum permitted under such applicable law.
11. INDEMNIFICATION. You agree to indemnify, defend and hold harmless U-Eat.com, its agents, employees, representatives, licensors, affiliates, officers, directors, and partners, from and against any all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys’ fees and court costs) resulting or arising from any third-party claim in connection with (a) any information you (or anyone accessing the Services using your password) submit or transmit through the Services, (b) your use of or access to the Services, (c)your violation of this agreement, (d) your violation of any rights of any third party, or (e) any viruses, Trojan horses, worms, time bombs, cancelbots, spyware, or other similar harmful or deleterious programming routines input by you into the Services.
12. INTELLECTUAL PROPERTY. The services and the Sites contain or comprise copyrighted and/or proprietary subject matter that is owned by U-Eat.com and/or its licensors. All such material is protected by relevant intellectual property laws, including copyright and/or trade secret laws. Without limiting anything herein, the material may not be copied, modified, reproduced, republished, posted, transmitted, sold, offered for sale, publicly performed, publicly displayed, or redistributed in any way without our prior written permission and the prior written permission of any applicable third-party entity. You must abide by all copyright notices, information or restrictions contained in or attached to any communication between you and U-Eat.com. In addition and without limiting the foregoing, all trademarks, service marks, trade names, domain names, slogans, logos, and other indicia of origin (“Marks”) that appear on or in connection with the Services are the property of U-Eat.com and/or its affiliates, partners, licensors and/or licensees. You are not authorized to use any such Marks. Ownership of all such Marks and the goodwill associated therein remains with us or those other entities.
13. MISCELLANEOUS. This Agreement and the relationship between you and U-Eat.com shall be governed and construed in accordance with the laws of England, without giving effect to any choice of laws or principles that would require the application of the laws of a different country or state. Any legal action, suit, or proceeding arising out of or relating to this Agreement, or your use of the Services, must be instituted exclusively in England and in no other jurisdiction. You further consent to personal jurisdiction and venue in, and agree to service of process issued or authorized by, any such court. U-Eat.com may provide you with notices, including those regarding changes to this Agreement, by email or by posting changes on the Sites. Our failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this agreement is found by a court competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and that the other provisions of this Agreement remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Services or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in this Agreement are for convenience only and have no legal or contractual effect. The Agreement constitutes the entire, exclusive and final statement of the agreement between you and U-Eat.com with respect to the subject matter herein, superseding any prior agreements or negotiations between you and U-Eat.com with respect to the Services. |
